Denise Callo may have been intoxicated, but she did not get intoxicated wth the passengers of the car. James Makekau who also lost his life on that tragic day had no alcohol in his system. There was also no evidence of recent use of marijuana for James Makekau. If you would research the FACTS of this case, you would understand that the rock wall which holds that area up on that cliff actually gave way underneath the weight of the car. Had the area been inspected over the past 55 years (!) the State would have seen a huge safety issue. The State had a very faulty defense, where officers of the law did not document information correctly, and even admitted that they did not conduct the investigation very thoroughly. The state's primary Traffic Investigator based his whole conclusion on a set of "tire marks" (that were admitted as evidence, but were never documented or recorded) that were later found to be about 25% too narrow to belong to the car in question. The state is liable to keep our roadways safe and address any safety issues as they occur. They failed horribly to do so.
